Filing for Chapter 13 Bankruptcy in Kentucky

In a Chapter 13 bankruptcy, people may be able to reorganize some or all of their eligible debts. Those who qualify are allowed to keep their property while they repay a portion of their debt over a three- to five-year time period. To be eligible for Chapter 13 bankruptcy, debtors must meet several criteria.

Those who file must not have had any debt discharged through Chapter 13 bankruptcy within the past two years. Furthermore, anyone who has had debt discharged through Chapter 7 bankruptcy in the past four years may not file for Chapter 13. The only option for those in that situation is to wait until the proper time has elapsed. A person applying for bankruptcy protection under Chapter 13 and who has had a bankruptcy case dismissed in the past 180 days cannot apply for protection.

In addition, individuals who wish to file must have filed all of their income tax returns in the past four years. The proposed repayment plan must allow for full repayment of most secured debt and partial repayment of some unsecured debts. During the repayment period, secured debt such as a mortgage or auto loan must remain current. Alimony and child support payments must also be made even though they are unsecured debts.
